File a Complaint with the Americans with Disabilities Act
Have you lost your job, been banned from somewhere or not given reasonable accommodation for your MCS or disability? All you do is just send an email or fax describing your situation, include all names, addresses and pertinent information is included to ada.complaint@usdoj.gov. That is How to File a Complaint with the Americans with Disabilities Act.
This is the for the American with Disabilities Act at the United States Department of Justice.
You don’t have to be officially declared “disabled” to use this act! I called and she told me that I definitely have a claim to report!
Anyone can send a complaint and the more complaints they get, the quicker things will start to change for the chemically sensitive, and the health of persons, animals and the planet in general!
The following is included in my complaint.:
I was banned from the Sports Club LA in 2009. I never got a reason, I received a vague letter stating that I wasn’t following rules and that their had been complaints about me. The real reason stems from an illness that I was suffering called Multiple Chemical Sensitivity.
I spent quite a bit of time at my gym. I went to African Dance classes 2 or times a week and Yala Dance workout another 2 times. I used weights and the sauna. Everything was going great until I came down with Multiple Chemical Sensitivity. Suddenly, the chemicals in perfumes, cleaning and personal care products would make me ill.
There is a long list of rules on the back of the Group Exercise Schedule and one of them states that members should not wear perfume. There was quite a lot of perfume in the group exercise rooms and the rest of the gym. I talked with many people in the management team and was told to talk to the teachers. I did this. I spoke with both of my teachers and they said they couldn’t do anything about it. I asked them if they could make an announcement and remind people now and then, but they did not want to do that.
I continued to go to the class. I tried wearing a mask, but that was uncomfortable and embarrassing. One day I asked a woman who had a strong perfume on if she could move toward the center. She asked me why I didn’t move instead. I explained that If I moved toward the center, there was another person on the other side who also had on strong perfume, so I needed to be near the door. The woman who I had asked to move over and the teacher had discussed this at some point, and it was apparently construed as me being racist.
After that the African Dance teacher, Angela Ingram, stopped the class twice to reprimand me about things that were common in the class. No one was ever reprimanded except for me. Also, in the dance class we would go across the floor in 3 or so lines. I always got in the front of the line, so that I wouldn’t have to follow behind people wearing perfumes, fabric softeners or hair products that made me ill. She would always rearrange the line so that I was behind someone. This was especially strange, as usually, you put the people who know the moves the best in the front of the row for others to follow. I had been devoted to that class and knew the dances as well or better than almost anyone there.
I knew she was trying to get me to quit, but I really loved this class. She was a great dancer and teacher.
One time, I was behind someone with strong perfume, so I moved. She told me I had to stay in the line and I told her that she knew of my illness and I could not stay in that line. She just kept doing this moving me out of the front of one of the various lines thing. One day when I wouldn’t move where she wanted me to move she stopped the music and left the class.
I had tried to work everything out with her earlier by letter and by conversation. I loved that class and had really liked this teacher. She refused to talk to me. I had talked with several of the Sports Club LA management personnel and they said that it was an issue between me and the teacher and they could do nothing. This was prior to the incident where she stopped the class and left.
Later, talking to management they said she had told them that I was “sniffing people”. I don’t know what else she said. It was a lie, especially since the last thing I wanted to do was inhale anyone’s chemical fragrances!
So, I was banned from the Sports Club LA by letter which doesn’t actually give any reason.
This was an awful chapter in my life and I would like my “club reward” money and for this situation to be rectified. I did learn a few helpful things including how to File a Complaint with the Americans with Disabilities Act.
UPDATE: I got a letter from the Department of Justice a year later stating that they did not have time to look into my claim.
Also, A few years later the gym was sold to Equinox, so I joined again, but quit becasue of the INTENSE germ killing “Morning Mist” they sprayed the saunas down with. So I quit. I go to sauna to detox. I was going to go for the weights but they are using strong chemical VIREX everywhere and I don’t want to absorb all that.
